These Terms of Service ("Terms") govern your use of AdsPilot AI ("the App", "the Service") provided by Tamsar, Inc. ("we", "us", "our"). By installing, accessing, or using AdsPilot AI, you ("Merchant", "you", "your") agree to be bound by these Terms.

What AdsPilot AI Does

AdsPilot AI is an AI-powered Google Ads automation platform for Shopify stores that provides:

• AI-Powered Campaign Optimization: Automated Google Ads campaign management and optimization
• Audience Management: Anonymous customer segmentation and targeting
• Performance Analytics: Conversion rate tracking and optimization insights

Service Availability

• Uptime Target: 99.9% service availability
• Maintenance Windows: Scheduled maintenance with advance notice
• Support Hours: Business hours EST with 24-hour response SLA
• Geographic Availability: Global service with regional data compliance

Account Terms

Eligibility

To use AdsPilot AI, you must:

• Be at least 18 years old or the age of majority in your jurisdiction
• Have a valid Shopify store and merchant account
• Provide accurate and complete registration information
• Comply with all applicable laws and regulations

Account Responsibilities

You are responsible for:

• Maintaining the security of your account credentials
• All activities that occur under your account
• Promptly notifying us of any unauthorized use
• Keeping your contact information current and accurate

Pricing and Billing

Subscription Plans

Free Plan:

• Basic features and limited usage
• Up to 1,000 monthly sessions
• Community support

Pro Plan ($29/month):

• Full feature access
• Unlimited sessions
• Priority support
• Advanced analytics

Enterprise Plan ($99/month):

• Everything in Pro

• Dedicated account manager
• Custom integrations

Billing Terms

• Billing Cycle: Monthly subscription billing through Shopify
• Payment Method: Charged to your Shopify account
• Auto-Renewal: Subscriptions automatically renew unless cancelled
• Price Changes: 30-day advance notice for any price changes

Data and Privacy

Data Handling

AdsPilot AI follows strict data minimization principles:

• No Customer PII: We do not collect personal information from your customers
• Merchant Data Only: We only access store configuration and product catalog data
• Your Control: You control all integrations and can revoke access anytime
• Secure Storage: All data encrypted in transit and at rest

Third-Party Integrations

By using AdsPilot AI, you authorize us to:

• Integrate with Google Ads (when you authorize it)
• Read your Shopify product catalog
• Process campaign optimization data

Acceptable Use

Permitted Uses

You may use AdsPilot AI to:

• Optimize your Google Ads campaigns
• Manage audience segmentation for your store

Prohibited Uses

You may not use AdsPilot AI to:

• Violate any applicable laws or regulations

• Google API Quotas: Subject to Google Ads and Sheets API rate limits
• Shopify Limits: Bound by Shopify platform limitations
• Data Processing: Processing times may vary based on data volume
• Feature Availability: Some features may require specific plan tiers

Service Dependencies

AdsPilot AI depends on third-party services:

• Shopify Platform: Core functionality requires active Shopify store
• Google Services: Integrations subject to Google service availability
• Internet Connectivity: Reliable internet connection required

Support and Maintenance

Support Services

• Response Time: 24-hour response for all support requests
• Support Channels: Email support and help documentation
• Business Hours: Monday-Friday, 9 AM - 6 PM EST
• Languages: English (primary), Spanish, French

Maintenance and Updates

• Regular Updates: Continuous service improvements and bug fixes
• Scheduled Maintenance: Advance notice for planned downtime
• Security Updates: Immediate deployment of critical security patches
• Feature Updates: New features rolled out with documentation

Liability and Disclaimers

Service Warranty

AdsPilot AI is provided "as is" with the following disclaimers:

• No Revenue Guarantees: We do not guarantee specific conversion rate improvements
• Third-Party Dependencies: Performance may be affected by external services
• Compliance Responsibility: You are responsible for compliance with advertising regulations

Limitation of Liability

Our liability is limited to:

• Direct Damages: Maximum liability limited to subscription fees paid
• Indirect Damages: Not liable for lost profits or consequential damages
• Service Interruptions: Service credits for extended downtime

Termination

Termination by You

You may terminate your subscription at any time by:

• Uninstalling the app from your Shopify admin
• Contacting support to cancel your subscription
• Cancelling through your Shopify billing settings

Termination by Us

We may terminate or suspend your access if:

• You violate these Terms of Service
• You fail to pay subscription fees
• We detect fraudulent or malicious activity
• Required by law or legal process

Effect of Termination

Upon termination:

• Your access to the service will be immediately suspended
• Your data will be deleted within 30 days
• You can export your data before termination
• No refunds for partial billing periods

Legal Terms

Intellectual Property

• Our Rights: We retain all rights to AdsPilot AI software and content
• Your Rights: You retain all rights to your store data and content
• License: We grant you a limited license to use the service
